Declaration of the American Association of Jurists (AAJ) denouncing the application of law violating human rights against Venezuelan migrants by the Government of the United States

The American Association of Jurists (AAJ) denounces the application by the United States government of the Enemy Alien Act of 1798 against Venezuelan migrants, openly violating the fundamental principles contained in Covenants, Agreements, Charters and Conventions signed by nations and protected by International Public Law.

The application of this aberrant and anachronistic Law, which is nothing more than the practical expression of criminal law applied to the enemy, a Nazi-fascist principle that justified the persecution and extermination of millions of people during the 20th century and so far in the 21st century, seeks to criminalize, without due judicial and administrative process, thousands of Venezuelan migrants in that country, subjecting them to acts that are degrading to their human condition, in order to subsequently commercialize them and transfer them as undesirable merchandise to El Salvador, whose government admits to having made a good deal with the US. 

Venezuelans residing in the United States are victims of a migration sponsored by that same country, imposing against the Bolivarian Republic of Venezuela for more than twenty years and affirmed since 2015 by the Executive Order of President Obama, which declared the brother country as an “unusual and extraordinary threat”, multiple and illegal para-tariff measures and more than 950 unilateral coercive measures, with the sole purpose of achieving the violent change of the government democratically elected by the Venezuelan people.

The AAJ strongly rejects these measures, which have generated terror and outrage in other Latino communities in the U.S., and which constitute a crime against humanity.

Declaración de la Asociación Americana de Juristas (AAJ) denunciando la aplicación de ley
violatoria de los derechos humanos contra migrantes venezolanos por el gobierno de los
Estados Unidos

La Asociación Americana de Juristas (AAJ) denuncia la aplicación, por parte del gobierno
de los Estados Unidos, de la Ley del Enemigo Extranjero de 1798, contra migrantes venezolanos,
violando abiertamente los principios fundamentales contenidos en Pactos, Acuerdos, Cartas y
Convenios suscritos por las naciones y resguardados por el Derecho Internacional Público.

La aplicación de esta aberrante y anacrónica Ley, que no es más que la expresión
práctica del derecho penal del enemigo, principio nazifascista que justificó la persecución y
exterminio de millones de personas durante el siglo XX y lo que va del siglo XXI, pretende
criminalizar, sin el debido proceso judicial y administrativo, a miles de venezolanos migrantes en
dicho país, sometiéndolos a actos vejatorios a su condición humana, para posteriormente
comercializarlos y trasladarlos como mercancías no deseables a El Salvador, cuyo gobierno
admite haber hecho un buen negocio con los EE.UU.

Venezolanos residiendo en los Estados Unidos, son víctimas de una migración auspiciada
por ese mismo país, al imponer contra de la República Bolivariana de Venezuela desde hace más
de veinte años y afirmada desde el 2015 por el Decreto Ejecutivo del presidente Obama, que
declaró al hermano país como una “amenaza inusual y extraordinaria”, de múltiples e ilegales
medidas paraarancelarias y más de 950 medidas coercitivas unilaterales, con el único objetivo
de conseguir el cambio violento del gobierno que democráticamente han elegido los
venezolanos.

La AAJ rechaza contundentemente estas medidas, que han generado terror e indignación
en otras comunidades latinas en los EE. UU., por lo cual se está constituyendo un crimen de lesa
humanidad.
